1. Agreement to these terms
These Terms of Use (“Terms”) govern your use of the Baggie mobile application, website, and related services (together, the “Services”), provided by Gino Studio Co. (“Baggie,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Services. If you use Baggie on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old to use Baggie. If the law where you live requires you to be older to consent to online services, that higher age applies. If you are under the age of legal majority, you represent that a parent or legal guardian has reviewed and agreed to these Terms for you.
3. Accounts and access
You agree to provide accurate account information and keep it current. You are responsible for activity under your account and for protecting access to your device and sign-in credentials. Tell us promptly at support@ginostudioco.com if you believe your account has been compromised.
You may sign in using a third-party provider. Your relationship with that provider is governed by its own terms and policies. You may not access another person’s account without permission or create an account using false or misleading information.
4. Using Baggie
Baggie lets you record travel-related information such as places, check-ins, memories, interests, and journey summaries. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app for your personal, non-commercial use.
Device permissions
Some features require optional device permissions, including location or photo-library access. You decide whether to grant them and may revoke them in your device settings. Revoking a permission may prevent the related feature from working. The photo journey feature processes photo metadata on your device and uploads only a journey summary you approve, as described in our Privacy Policy.
Location and travel information
Place suggestions, maps, distances, country detection, and similar information may be incomplete, delayed, or inaccurate. Baggie is a journal, not a navigation, emergency, or safety service. Always follow official information and exercise appropriate judgment while traveling.
5. Your content
You retain ownership of notes, memories, place submissions, and other content you submit to Baggie (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, and otherwise process Your Content only as needed to operate, secure, improve, and provide the Services to you.
You represent that you have the rights needed to submit Your Content and that it does not violate law or another person’s rights. You are responsible for maintaining your own copies of content that is important to you.
6. Acceptable use
You may not:
- use the Services for unlawful, fraudulent, harmful, or abusive activity;
- infringe intellectual-property, privacy, publicity, or other rights;
- upload malicious code or interfere with the security or operation of the Services;
- probe, scan, or test vulnerabilities without our written authorization;
- scrape, reverse engineer, or bypass technical limits except where law permits it;
- impersonate another person or misrepresent your affiliation; or
- use automated means to create accounts or access the Services at unreasonable volume.
7. Baggie’s rights
The Services—including their software, visual design, branding, text, and other materials— are owned by Baggie or its licensors and are protected by intellectual-property laws. These Terms do not grant you any right to use our trademarks, logos, or branding. Feedback you choose to provide may be used by us without restriction or compensation to you.
8. Third-party services
Baggie may depend on or link to services provided by others, including sign-in, maps, app stores, and hosting providers. We do not control third-party services and are not responsible for their content, availability, or practices. Their terms and privacy policies apply to your use of them.
9. Suspension and termination
You may stop using Baggie at any time and may request account deletion as described in our Privacy Policy. We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or possible legal exposure, or if needed to protect the Services or other users. Where appropriate, we will provide notice and an opportunity to appeal.
Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute terms—will survive.
10. Changes to the Services or Terms
We may add, change, or discontinue features. We may also update these Terms. If a change is material, we will provide reasonable notice in the app or by another appropriate method. The revised Terms take effect on the date stated at the top. Your continued use after that date means you accept the updated Terms.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Services will always be uninterrupted, secure, or error-free, or that travel and location information will be complete or accurate.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
12. Limitation of liability
To the fullest extent permitted by law, Baggie and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from or related to the Services.
Our total liability for all claims relating to the Services will not exceed the greater of the amount you paid us for the Services during the 12 months before the event giving rise to the claim or USD 100. These limits apply only to the extent permitted by law.
13. Governing law
These Terms are governed by the laws of Thailand, without regard to conflict-of-law rules. Courts located in Bangkok, Thailand will have exclusive jurisdiction over disputes, except where the consumer-protection law where you live gives you the right to bring a claim in your local courts or requires another governing law.
If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or sale of assets.
